The Core Legal Framework

Scaffolding safety in New Zealand is governed primarily by:

• Health and Safety at Work Act 2015 — Sets the overarching duty of care
• Health and Safety at Work (General Risk and Workplace Management) Regulations 2016 — Specific requirements for working at height
• AS/NZS 4576:2020 Guidelines for Scaffolding — The technical standard that defines what compliant scaffolding looks like

When Is Scaffolding Required?

WorkSafe requires fall protection for any work at height where there is a risk of falling. In practice, this means:

• Above 3 metres — Fall protection is required. Scaffolding, edge protection, or a safety net system must be in place
• Above 5 metres — Must be erected by a Competent Person (trade-qualified scaffolder)
• Suspended scaffolding — Has additional requirements including engineering certification

Who Is a "Competent Person"?

A Competent Person for scaffolding is someone with the training, knowledge, and experience to safely design, erect, and dismantle a scaffolding. In New Zealand, this typically means a scaffolder who holds the National Certificate in Scaffolding (or equivalent qualification).

For scaffolding above 5 metres, the law specifically requires a Competent Person to be involved.

Inspection Requirements

Scaffolding must be inspected:

• Before first use
• After any alteration or incident
• At regular intervals (at least every 7 days for scaffolding in continuous use)

Inspection records must be kept.

Even if you're not doing the work yourself, you have responsibilities as the person who controls the property. You should:

• Ensure any scaffolding on your property is erected by a qualified company
• Not interfere with or modify the scaffolding
• Ensure it remains in place until the work is complete and signed off
