Terms of Trade

1. Parties
These Terms of Trade ("Terms") govern the provision of scaffolding hire and related services by Erect It Scaffolding Services Ltd ("Erect It", "we", "us") to the customer ("Customer", "you"). By engaging our services or accepting a quote, you agree to these Terms.
2. Quotations
- All quotes are valid for 30 days from the date of issue unless otherwise stated.
- Quotes are based on information provided by the Customer and are subject to site inspection. We reserve the right to revise a quote if site conditions differ materially from those described.
- Acceptance of a quote constitutes agreement to these Terms.
3. Hire Period
- Hire charges begin on the date of erection and continue until the scaffolding is dismantled by Erect It.
- The Customer must give reasonable notice (minimum 48 hours) when requesting dismantling.
- Extended hire beyond the agreed period will be charged at the agreed weekly rate or as otherwise specified in the quote.
4. Payment & Charges
- You agree to pay Erect It Scaffolding all charges for erection, modification, dismantling, transport, replacement, repair and hire of the Equipment. There will be no reduction in charges for weekends, public holidays, inclement weather, project delays or any other circumstance beyond our reasonable control.
- For non-account customers, all quoted labour charges (EDC) are payable prior to delivery unless otherwise stated in our quote. Rental and other charges are invoiced monthly and payable by the due date on the invoice.
- For account customers, costs will be invoiced at erection of the job on a monthly basis as per our quote (refer to "Important Notes"). Any remaining quoted labour costs will be charged upon off-hire of the Equipment. Extra work will be invoiced in the month it is carried out. Rental charges are invoiced monthly with a minimum hire period of one week. All invoices to account customers are payable by the 20th of the month following the invoice date. Retentions may not be withheld.
- Unpaid invoices will incur interest at 2% per month from the due date. You will reimburse Erect It Scaffolding for all collection costs (including legal costs on a solicitor-and-client basis) incurred in recovering outstanding amounts.
- If no rate has been agreed for extra work it will be charged at our standard charge-out rate plus materials, travel and GST. Extra work includes any modification, moves, repairs or adjustments to the Equipment not itemised in the quote. Any additional Equipment will be charged at our standard hire rates.
- Unless specifically stated in our quote, all labour rates are based on work between 7:00am and 4:30pm Monday–Friday (excluding public holidays). Work and travel time outside these hours will be charged at a minimum of 1.5 times our standard charge-out rate plus GST.
- If on termination of hire the Equipment is not returned or made available to Erect It Scaffolding in good order and condition then hire will continue until the Equipment is returned, cleaned and/or repaired to a condition suitable for re-hire. We will take reasonable steps to clean and/or repair such Equipment at your expense.
- You will pay Erect It Scaffolding the retail cost of all Equipment that is lost, damaged beyond economic repair, or stolen while on hire to you. If damaged Equipment can be repaired you will pay the repair cost.
- Except as set out in the Construction Contracts Act 2002, all payments are to be made by you by the due date without set-off or deduction.
- All prices are exclusive of GST unless otherwise stated.
- We reserve the right to suspend or remove scaffolding if payment is overdue.
5. Customer Responsibilities
The Customer agrees to:
- Provide clear and safe access to the site for erection, inspection, and dismantling.
- Not modify, move, alter, or interfere with scaffolding erected by Erect It without prior written consent.
- Ensure the scaffolding is used only for its intended purpose and by authorised persons.
- Report any damage, defects, or safety concerns to Erect It immediately.
- Obtain any necessary permits, consents, or permissions required for scaffolding installation on or over public property.
6. Damage and Loss
- The Customer is responsible for any damage to or loss of Erect It's equipment during the hire period, fair wear and tear excepted.
- The Customer shall notify Erect It of any damage or theft as soon as practicable.
- Repair or replacement costs for damaged or lost equipment will be charged to the Customer.
7. Health & Safety
- Erect It will erect and dismantle scaffolding in accordance with WorkSafe New Zealand guidelines and applicable legislation.
- The Customer must ensure the scaffolding is used safely and that all persons using it are appropriately trained and equipped.
- The Customer must not allow the scaffolding to become overloaded beyond its rated capacity.
8. Liability
- Erect It's liability to the Customer is limited to the value of the services provided under the relevant invoice.
- Erect It is not liable for any indirect, consequential, or special loss or damage arising from the use of its services or equipment.
- Nothing in these Terms limits liability that cannot be excluded by law, including under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where applicable.
9. Weather Protection & Engineering
- Engineer's fees for scaffolding design and inspection, and the costs of any additional bracing required by the Engineer, are payable by the Client.
- Shrinkwrap systems can only be applied in dry and relatively calm weather. Delays caused by unsuitable weather will not prevent the scaffolding hire period from commencing once erection and tagging are complete.
- We will maintain and repair shrinkwrap at no charge if damaged by wind up to 80 km/h as recorded at the nearest weather station by metservice.co.nz. Repairs for damage caused by any other means are payable by the Client.
- Weather protection systems (shrinkwrap) are not guaranteed to be watertight. We accept no responsibility for damage caused by water ingress.
10. Cancellation
- Cancellation of a confirmed booking must be made in writing at least 48 hours before the scheduled erection date.
- Late cancellations or no-shows may be subject to a cancellation fee of up to 50% of the quoted value.
11. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
